Lakeland commissioners voted 4-3 on August 3, 2026 to impose a one-year moratorium on new data centers and on any other business expected to draw at least 50 megawatts of electricity. Two things make this ordinance unusual. First, it is not limited to data centers as a category — the trigger is the 50 MW load, so a large industrial customer of any description is caught by the same rule. Second, and more significant, it reaches beyond the city's borders. The moratorium applies both inside Lakeland and to projects located outside the city that seek service from Lakeland's utilities. That matters because nearly 70% of Lakeland Electric's service area lies outside the city limits, where Lakeland has no land-use authority at all but can still be asked to power a project. Using utility service as the hook lets the city reach developments it cannot zone. The pause took effect immediately, stopping the city from accepting or reviewing applications while staff write permanent rules covering power and water demand, noise, public safety, environmental effects, impacts on nearby properties, infrastructure costs, jobs and tax revenue. It can run up to twelve months but commissioners may end it sooner if the work finishes. The vote was contested: Commissioners Stephanie Madden, Mike Musick and Ashley Troutman were strongly opposed to the language and voted no.
Who is protected: Lakeland residents and Lakeland Electric ratepayers — including the roughly 70% of the utility's service area outside the city limits, who gain protection they could not get through Lakeland's zoning power.
Legal detail
City of Lakeland, Fla. Ordinance 26-018, adopted 4-3 by the City Commission August 3, 2026, effective immediately, maximum term twelve months with discretionary early termination once permanent regulations are complete. TRIGGER IS LOAD, NOT USE: applies to new data centers and to other businesses anticipated to consume at least 50 megawatts of electricity, so scope is set by grid impact rather than by how a project describes itself. EXTRATERRITORIAL REACH VIA UTILITY SERVICE — the distinguishing feature: the moratorium binds both projects inside the municipal boundary and projects outside it that request service from Lakeland's utilities. Approximately 70% of Lakeland Electric's service territory lies beyond the city limits, where the city has no zoning jurisdiction; conditioning utility service supplies the only lever available over those projects. Municipal utilities elsewhere have the same structural position and largely have not used it this way. Operative effect: the city may not accept or review covered applications during the term. Study agenda for permanent rules: power and water demand, noise, public safety, environmental effects, effects on neighbouring properties, infrastructure cost allocation, employment and tax revenue. Recorded dissents: Commissioners Stephanie Madden, Mike Musick, Ashley Troutman. Ordinance text published in the City Commission agenda packets for July 20 and August 3, 2026 (lakelandgov.net, 26-018Ord.pdf).
