Legal detail
Oldham County Fiscal Court approved, 4-2 on July 1, 2025, a 150-day moratorium pausing any application to build a data center in the county, striking draft language that would have exempted Western Hospitality Partners' pending application (100 MW, after its original 600 MW / $6B proposal on KY 53 was withdrawn). Reporting at the time describes scope covering data centers, private utilities and data storage facilities. The 150-day term would have lapsed around late Nov 2025; WAVE reporting in Aug 2026 states the moratorium remains in place and will stay until a data center ordinance is passed (the extension instrument and date were not located). On Aug 18, 2026 the Fiscal Court denied the planning commission's proposed regulations (1,000 ft setback from neighboring properties, 1,500 ft from schools) to retain an expert for redrafting; a magistrate floated a permanent moratorium, which Judge-Executive David Voegele cautioned against.
