Two companies that own about 911 acres along Carpenter Canyon Road and State Route 160 near Pahrump have gone to court to overturn Nye County's August 2026 ban on data centers in the Pahrump area's over-appropriated water basin. The companies, which planned the Manse Technology Campus, argue the county had effectively approved their plan and that the ban unlawfully reaches back to undo their reliance on existing zoning and violates their property rights. They ask the court to reverse the ordinance, allow the project and award attorney's fees. Commissioner Ian Bayne, who proposed the ban, said he remains confident in it.

Legal detail

Petitioners: CDDC, LLC and 9 of a Kind, LLC (Manse Technology Center/Campus, 'MTC Project'; developer Sean Dalesandro); ~911 acres along Carpenter Canyon Road and NV SR 160. Respondents: Nye County (and, per PVT, Pahrump Regional Planning Commission referenced in docket). Challenged measure: Nye County Ordinance No. 631 (per developer statement) — the Basin 162 data center ban adopted August 2026 (dataset entry Nye County NV data center ban in Basin 162 (2026), Bill No. 2026-11). Theories: common-law property rights; reliance on prior zoning and county guidance; claim that the Pahrump Regional Planning Commission's 'specific plan' designation is void as vague and standardless; retroactivity. Relief: reverse ordinance, allow project, attorney's fees. Filed 'earlier this month' (September 2026) per developer; no county response on docket and no initial court date as of the PVT/RJ report (Sept. 29). NOT ESTABLISHED: case number; exact filing date; court department.
