Florida political ads that use generative AI to depict a real person doing something they never did — with intent to injure a candidate or deceive voters — must carry a clear disclaimer that the content was created with generative AI. Failing to include the disclaimer is a first-degree misdemeanor.

CS/HB 919 (Ch. 2024-126, Laws of Fla.; presented to Governor Apr. 26, 2024; approved Apr. 29, 2024; eff. July 1, 2024) creates Fla. Stat. § 106.145: a political advertisement, electioneering communication, or other miscellaneous advertisement of a political nature containing content created in whole or in part with generative AI that appears to depict a real person performing an action that did not actually occur, and was created with intent to injure a candidate or to deceive regarding a ballot issue, must prominently state "Created in whole or in part with the use of generative artificial intelligence (AI)." Format rules for print (bold, >= 12 pt), TV/video (>= 4% of vertical picture height), graphic and internet communications. Failure is a first-degree misdemeanor for the person identified as paying for, sponsoring or approving the ad, in addition to civil penalties; any person may file a complaint with the Florida Elections Commission, with expedited hearings.
