On September 9, 2020, Portland, Oregon became the first U.S. city to ban both government AND private-sector use of facial recognition in places of public accommodation. The private-sector ban — codified at Portland City Code Ch. 34.10 — included a private right of action and remains the broadest municipal FR ban in the United States.

Portland passed two ordinances simultaneously on Sept. 9, 2020: (1) Ord. No. 190113 — Portland City Code Ch. 34.10, prohibiting private entities from using face recognition technologies in places of public accommodation (private right of action, $1,000/day per violation or actual damages); (2) Ord. No. 190114 — prohibiting city-bureau use of face recognition. Effective Jan. 1, 2021 (private sector); immediately on adoption (city bureaus).
