Texas Gov. Greg Abbott ordered the state's environmental agency, the Texas Commission on Environmental Quality, to stop issuing permits sought by data centers. The September 21, 2026 letter says no state agency should move forward with data center approvals until the grid operator ERCOT, the Public Utility Commission and the Water Development Board finish gathering information in their data center audits. TCEQ must pause all data-center-related permits until ERCOT completes its review and report back to the governor by October 19, 2026. The letter also says Abbott will ask the Legislature to eliminate financial incentives for data centers.

Legal detail

Gubernatorial directive letter (not a statute, rule or executive order) dated Sept. 21, 2026 (a Monday), Gov. Greg Abbott to TCEQ Executive Director Kelly Keel. Text: 'With this letter I am directing the Texas Commission on Environmental Quality (TCEQ) to halt all permits sought by data centers' ... 'no other state agency shall move forward with regulatory approvals related to data centers until this information is acquired. Therefore, I direct the TCEQ to pause the issuance of all permits related to data center projects until ERCOT completes its review.' Builds on the PUC/ERCOT audit directive (Texas Gov. Abbott data center grid-connection audit freeze) and the Sept. 14 TWDB water-reporting directive (Texas TWDB data center water reporting penalties (2026)). Stated policy conditions: data center projects must cover all electrical infrastructure costs, result in lower residential electrical bills, complete the ERCOT and TWDB audits, not use water needed by local communities, report electricity and water usage, and abide by setback requirements; the Governor will work with the Legislature to eliminate financial incentives. TCEQ compliance update due Monday, Oct. 19, 2026. IMPLEMENTATION (TechTarget, Sept. 24, 2026, quoting TCEQ external relations director Ryan Vise): TCEQ has paused all air and water permits and other authorizations for construction or development of infrastructure directly supporting data centers; TCEQ has not said whether projects outside ERCOT's interconnection process are covered. Other dates per TechTarget: Oct. 12 ERCOT State and Community Impact RFI responses (applies to developers with >=25 MW peak requested load), Dec. 10 ERCOT report to the PUC. NOT ESTABLISHED: a fixed end date (pause runs until ERCOT completes its review); legal authority of the directive over an independent commission; coverage of behind-the-meter/islanded projects (law-firm commentary conflicts).
