Athens, Ohio — Ordinance 70-26: One-Year Data Center Moratorium Covering AI and Bulk Storage Facilities, Extendable Another Year by the Mayor, That Does Not Reach the Project That Inspired It (August 3, 2026)

- Status
- In effect
- Expires
- August 3, 2027
- Applies to
- Developers seeking to site AI or data storage facilities WITHIN the Athens city limits — the moratorium does not reach sites outside the corporate boundary
- Enforced by
- City of Athens zoning administration / Athens City Council; extension vested in the Mayor and/or service-safety director
Athens City Council unanimously adopted Ordinance 70-26 on August 3, 2026, imposing a one-year temporary moratorium on data centers in the city. The ordinance is drafted to cover both facilities for artificial intelligence and those primarily directed at storing vast quantities of digital data — covering both uses matters, because an AI-only definition can miss a pure storage facility and vice versa. At Mayor Steve Patterson's request the ordinance also gives the mayor and/or the service-safety director the option to EXTEND the moratorium by another year, which puts the extension decision in executive hands rather than requiring a fresh council vote. The purpose is to give city officials time to review the zoning code and address the issues data centers raise, principally their significant energy and water consumption. There is an irony in the record that is worth preserving. The moratorium was inspired by a New York developer's interest in building a data center on land across the highway from Athens High School — but it does NOT apply to that site, because the site lies outside the city limits. This is the fourth instrument in this dataset to fail to reach the project that prompted it, the others being Rockford (annexation agreement), Salem (pre-filed application) and Lowell (litigation settlement). Athens County's commissioners separately adopted an anti-data-center resolution and township trustees approved a yearlong pause on zoning for a data center.

Legal detail
City of Athens, Ohio (Athens County) — ORDINANCE 70-26, adopted unanimously by City Council on Monday, August 3, 2026, imposing a one-year temporary moratorium on data centers. DEFINITIONAL SCOPE: applies to data centers FOR ARTIFICIAL INTELLIGENCE as well as those PRIMARILY DIRECTED AT VAST QUANTITIES OF DIGITAL DATA STORAGE — covering both categories rather than one, which forecloses the argument that a pure storage facility falls outside an AI-framed moratorium or that an AI compute facility falls outside a storage-framed one. EXTENSION MECHANISM, added at Mayor Steve Patterson's request: the ordinance language gives THE MAYOR AND/OR THE SERVICE-SAFETY DIRECTOR the option to extend the moratorium BY ANOTHER YEAR. Vesting the extension in the executive rather than requiring a further council vote is uncommon and materially changes the politics of expiry — no new public hearing is needed to keep the pause in force. PURPOSE: time for city officials to review the zoning code and make changes addressing issues raised by data centers, principally significant energy and water consumption. THE TERRITORIAL LIMIT IS THE INSTRUCTIVE PART: the moratorium was inspired by a NEW YORK DEVELOPER'S interest in land ACROSS THE HIGHWAY FROM ATHENS HIGH SCHOOL, and it DOES NOT APPLY to that location because the site is OUTSIDE THE CITY LIMITS. Municipal authority ends at the corporate boundary; a city moratorium cannot reach an adjacent unincorporated or township parcel. This is the fourth documented instance in this dataset of a measure failing to reach its motivating project \u2014 compare Rockford IL six-month data center moratorium (2026) (annexation agreement), Salem OR 120-day data center moratorium (Res. 2026-40) (pre-filed application) and Lowell MA Markley data center diesel generator injunction (2026) (litigation settlement). RELATED ATHENS COUNTY ACTION, not independently indexed: the Athens County Commissioners adopted an anti-data-center resolution, and township trustees approved a yearlong pause on zoning for a data center.
