New Jersey Governor Sherrrill signed the Forbidding the Algorithmic Inflation of Rent (FAIR) Act on July 20, 2026, making New Jersey the first state to ban landlords from using algorithmic revenue-management software that coordinates rent-setting using nonpublic competitor pricing and occupancy data. The law, effective July 20, 2027, prohibits residential landlords from using or paying for such software and from receiving pricing recommendations derived from competitors' nonpublic data. RealPage and similar tools are directly targeted.

Prohibits residential landlords from (1) using algorithmic pricing software that pools nonpublic competitor rent, occupancy, or lease-termination data to generate pricing recommendations, (2) contracting for such software, or (3) accepting pricing recommendations derived from competitor nonpublic data. Violations subject to civil penalties. Private right of action available to tenants. Targets RealPage-class revenue-management tools. NJ is first US state to codify a ban. The national RealPage enforcement wave includes DOJ consent decree (us-doj-realpage-consent-decree-2025) and Philadelphia class actions (litig-liu-v-willow-bridge-realpage-philly-2026).
